1. Who we are and what Abeng is
1.1 These Terms of Service (“Terms”) govern access to and use of abeng.org, related subdomains, mobile surfaces, RSS feeds, APIs, and linked Abeng-operated services (together, the “Platform”), operated by Abeng Media (“Abeng”, “we”, “us”, “our”). For details on who runs and operates Abeng, contact us by email at [email protected].
1.2 Abeng is an independent news reader and media aggregator. Unless an item is clearly marked as original Abeng reporting, commentary, or editorial, we do not claim to be the original publisher of third-party news. We collect, organise, summarise, translate, tag, and link to material from licensed Jamaican and other publishers, with source attribution on every article and links to the original publisher where available.
1.3 Abeng is not a law firm. Legal summaries, forms, or contextual material surfaced through or linked from Jurifi or similar tools are informational only and are not legal advice.
1.4 Sister products (including Inbox, Jurifi, OFMOP, Captureland, and Matsil) may be operated separately. Abeng does not endorse third-party content surfaced through them unless we say so in writing.
2. Acceptance and changes
2.1 By accessing or using the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Platform.
2.2 Where the Electronic Transactions Act applies, your electronic acceptance (including clicking “I agree”, creating an account, or continuing to use the Platform after notice) has the same effect as a written signature.
2.3 We may change these Terms. For material changes, we will give at least 30 days' notice by email to registered users (where we have an address) and/or a prominent on-site notice before the new effective date. Continued use after the effective date constitutes acceptance. If you disagree, stop using the Platform and close your account.
3. Eligibility and accounts
3.1 The public news reader may be used without registration. Certain features (including Inbox, saved preferences, or authenticated services) require an account.
3.2 You must be 18 or older to create an account. The Platform is not directed at children under 18.
3.3 You are responsible for activity under your account, for keeping access credentials and one-time codes secure, and for accurate registration information.
3.4 Inbox may use SMS one-time passwords instead of passwords for normal sign-in. Message and data rates from your carrier may apply.
3.5 We may suspend or terminate accounts for breach of these Terms, abuse, unlawful use, or risk to the Platform or third parties, with or without notice where reasonably required.
4. Editorial model, aggregation, and AI
4.1 Abeng's mission is to make Jamaican information more accessible. Our editorial standards (as described on our About page) include:
- aggregation from licensed publishers and credited sources;
- clear source labelling on articles;
- links back to original publishers where available;
- AI-assisted summarisation, translation, tagging, and optional legal or civic context, clearly labelled as such;
- no representation that AI output replaces primary reporting or professional advice.
4.2 Headlines, excerpts, thumbnails, metadata, and short extracts are presented to identify and link to the underlying story. They are not a substitute for the full article at the source.
4.3 Translation into multiple languages is provided for accessibility. Meaning may differ from the source; the publisher's original language version controls for accuracy disputes.
4.4 We may correct, update, retract, or remove items for editorial, legal, technical, or rights reasons. A correction request does not by itself stop limitation periods under the Limitation of Actions Act.
5. Intellectual property and permitted use
5.1 Third-party content (articles, broadcasts, images, video, trademarks, and logos) remains the property of the respective rights holders. Abeng claims rights only in its selection, layout, branding, software, summaries, translations, tags, and original material.
5.2 Subject to these Terms and applicable law, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for personal or internal organisational news reading.
5.3 RSS feeds and similar syndication endpoints are for use in personal or organisational feed readers. You must not:
- republish full article text commercially without permission from the rights holder;
- remove attribution or misrepresent the source;
- scrape or harvest the Platform in a way that impairs our systems or circumvents technical limits;
- use Abeng content to train models or build competing datasets without our written consent.
5.4 The Copyright Act and applicable fair dealing or licensing principles apply to republication. Rights holders with concerns should contact [email protected] (subject: Rights-Holder Complaint).
6. User content and conduct
6.1 If you submit feedback, tips, comments, attachments, or other material (“User Content”), you represent that you have the right to submit it and that it is accurate to the best of your knowledge.
6.2 You grant Abeng a worldwide, royalty-free licence to use, reproduce, adapt, publish, and display User Content for operating, improving, and promoting the Platform, and for journalistic purposes, subject to the Privacy Policy.
6.3 You must not use the Platform to:
- violate Jamaican or applicable foreign law;
- defame, harass, threaten, or invade privacy;
- upload malware or attempt unauthorised access;
- impersonate others or misrepresent affiliation;
- infringe copyright, trademark, or other IP rights.
6.4 We may remove User Content and restrict access at our discretion. We are not obliged to monitor all User Content.
7. Defamation, republication, and complaints
7.1 Jamaican defamation law (including the Defamation Act and Libel and Slander Act) applies to statements published in Jamaica. Abeng does not intend to publish new defamatory meanings beyond what appears in attributed source material republished in good faith.
7.2 For third-party material republished with prominent attribution and a link to the source, Abeng's role is that of aggregator and pointer, not author, except where we add clearly labelled Abeng editorial or AI-generated summary.
7.3 Abeng may rely on defences available in law, including justification, fair comment on matters of public interest, qualified privilege, and, where applicable, innocent dissemination for good-faith republication with attribution, subject to proof on the facts.
7.4 Complaints, corrections, and takedown requests: [email protected], with the Abeng URL, source link, and specific words complained of. We will acknowledge and review in good faith; response times vary by complexity and volume.
7.5 Nothing in these Terms limits any party's right to seek relief in court where the law allows.
8. Disclaimers
8.1 The Platform is provided “as is” and “as available”. To the fullest extent permitted by law, Abeng disclaims warranties of merchantability, fitness for a particular purpose, accuracy, completeness, timeliness, and non-infringement in respect of third-party and AI-assisted content.
8.2 We do not guarantee uninterrupted or error-free service. News may be delayed, incomplete, or later corrected at the source.
8.3 Investment, health, legal, and official information in aggregated news is general information only. Verify with qualified professionals and primary sources before acting.
9. Limitation of liability
9.1 To the fullest extent permitted by Jamaican law, Abeng is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunity, arising from use of the Platform.
9.2 Our aggregate liability for claims relating to the Platform (other than liability that cannot be excluded by law) is limited to the greater of (a) JMD 50,000 or (b) the fees you paid Abeng in the twelve (12) months before the claim. For free public reading, (b) may be zero.
9.3 These limits do not apply to death or personal injury caused by our negligence, fraud, or other liability that cannot be limited by law.
9.4 Where third-party publishers are responsible for the underlying report, primary responsibility for the original publication remains with them; these Terms do not transfer that responsibility to Abeng for good-faith attributed aggregation.
10. Indemnity
You agree to indemnify and hold harmless Abeng and its operators from claims, losses, and reasonable costs (including legal fees) arising from your User Content, your breach of these Terms, or your unlawful use of the Platform, except to the extent caused by Abeng's deliberate wrongdoing or negligence.
11. Third-party links and services
11.1 The Platform links to publishers, broadcasters, government sites, and companion products. We do not control and are not responsible for their content, terms, or privacy practices.
11.2 Your use of Inbox, Jurifi, OFMOP, Captureland, Matsil, or other linked services is governed by their respective terms and policies.
12. Governing law and disputes
12.1 These Terms are governed by the laws of Jamaica.
12.2 The courts of Jamaica have non-exclusive jurisdiction, subject to mandatory consumer or constitutional provisions.
12.3 Before formal proceedings, the parties will attempt good-faith negotiation for 30 days after written notice to [email protected]. Either party may then refer the dispute to mediation through the Dispute Resolution Foundation (or successor). Arbitration under the Arbitration Act 2017 applies only by written agreement of the parties.
13. General
13.1 If any provision is invalid, the remainder stays in effect.
13.2 Failure to enforce a provision is not a waiver.
13.3 You may not assign your rights without our consent. We may assign our rights in connection with a reorganisation or sale of the Platform.
